TERMS OF SERVICES AND ACCEPTABLE USE POLICY

Dear user!
Please read carefully this agreement before registration.
This VIPGAMESZONE End-User License Agreement ("EULA") is a legal agreement between you ("you") and VIPGAMESZONE for the services and software products mentioned below.
By registration on VGZ Sound track, installing, copying, or otherwise using the Software, by using our services you agree to be bound by the terms of this EULA, our acceptable use policy and our privacy statement.
1. ACCEPTABLE USE POLICY
We've developed this Acceptable Use Policy (AUP) to help our Users understand their responsibilities when using our services.
1.1. LAWFUL USE.
1.1.1. Our services may only be used to engage in lawful activities. If any user will use our services for unlawful activities VIPGAMESZONE reserves the right to close his(her) account and to remove his(her) registration any time without any notification.
1.1.2. Child Pornography. We prohibit use of our services for the uploading, saving, distribution or dissemination of child pornography.
1.1.3. War and violence. You may not use our service to upload, save, distribute any content which propagandizes violence, war, race discrimination, terrorism.
1.1.4. Online Gambling. You may not use our services to engage in the online making, receiving, recording or forwarding of bets or offers to bet. You may not link to sites that engage in such activities.
1.1.5. Piracy materials. You may not use our services to engage in the online making, receiving, recording, saving or forwarding of any kinds of piracy materials.
1.1.6. Electronic Crimes and Security. Users may not engage in the act of sending or distributing malicious code or information regarding the creation of Internet viruses, worms, Trojan Horses, mail bombing or denial of service attacks.
1.1.7. Third party content. You may not use our services to distribute third party content without the prior written consent of the owner of this content.
1.1.8. Other Illegal Activities. You may not use this service to do harm to any person (company, organization), to get any data from computer of other person (company, organization), to publish any private information of any other person (company, organization).
1.2. US LAWS.
1.2.1. All material on our server must comply with United States laws. In addition, all material placed on our server by our users must be legal in the user's own jurisdiction. VIPGAMESZONE will cancel the account of any user who knowingly infringes US laws.
1.2.1. U.S. Export and Import Laws. Users may not use our services to engage in a violation of U.S. export and import control laws.
1.2.3. Pornography. No user shall use VIPGAMESZONE services to engage in pornography. This includes uploading or publishing material that would commonly be considered "indecent," "appealing to the prurient interest" or referred to as "adult" material.
1.3. INTELECTUAL PROPERTY.
1.3.1. Intellectual Property. Users may not engage in activities that infringe or misappropriate the intellectual property rights of others. This includes, but is not limited to, infringing copyrights, trademarks, service marks, trade secrets, software or patents held by other individuals, corporations or entities. VIPGAMESZONE will cancel the account of any user who knowingly infringes intellectual property laws.
1.3.2. Common instances leading to intellectual property violations involve the unauthorized use of pictures, framing another's Web site within your own without permission and using another's trademarks without their permission to promote competing goods or services.
1.4. VIPGAMESZONE COPYRIGHT©.
1.4.1. VIPGAMESZONE Copyrighted Material. It is also our policy to protect its own intellectual property rights. The use of content or marks found on our Web site, or use of the name «VIPGAMESZONE" without the prior written consent of VIPGAMESZONE, is prohibited. Any infringement of’s intellectual property rights will result in immediate termination by of the infringing’s contract.
1.5. DISTRUPTIVE ACTIVITY AND COMUNICATIONS.
1.5.1. Spamming - Because SPAM can impair our ability to deliver quality services, users are prohibited from sending, assisting, or commissioning the transmission of commercial e-mail that does not comply with the U.S. CAN-SPAM Act ("SPAM") of 2003.
1.5.2. Offensive Communication - harassment, defamation, libel and hate speech - Users are prohibited from using our services to engage in activities that may be considered harassing, defamatory, libelous or malicious.
1.6. USE OF OUR SERVICES.
1.6.1. Unauthorized Reselling or Providing Access to Account Services. Users cannot resell or provide access to e-mail services, tools or access codes/passwords that are not being used to maintain a user’s account.
1.6.2. Exploits. Users may not use their or third party programs on their account, such as CGI, Perl, PHP, etc.
1.6.3. Other Activities or Information. Users are prohibited from taking part in any activity or information, lawful or unlawful that could be considered harmful, offensive or controversial for VIPGAMESZONE, its users or third-parties.
1.7. REMEDIES AND ACTIONS.
1.7.1. In General. When we become aware of a violation of our AUP, it is at our sole discretion to respond in the manner we believe to be appropriate for stopping the offending activity, including but not limited to, removing or blocking access to material, shutting down an account, blocking offending transmissions, deleting the account and all associated information and files.
1.7.2. Presenting Complaints and Notice. We reserve the right to use our best judgment to determine who bears the burden of proof for alleged AUP violations. We also reserve the right to take any and all action that we deem appropriate and bear no responsibility for verifying/investigating complaints and responses.
2. PRIVACY STATEMENT
2.1. You warrant that the contact information, as listed on the VIPGAMESZONE registration form, is correct, complete and an accurate representation of your contact details. You also warrant that you are a valid representative of the entity or organization listed on our signup form, and are at least 13 years of age.
2.2. Any of the terms, prices or services offered can be amended, modified or updated by VIPGAMESZONE at any time.
2.3. Public Forums VIPGAMESZONE may make chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.
3. USER’S RESPONSIBILITY
3.1. User is responsible for uploading Web site files and/or providing and setting up any Web site content. VIPGAMESZONE is not responsible for modifying, correcting or updating user’s account material.
3.2. User is responsible for the content of any postings, data or transmissions. This responsibility extends to any individuals or entities given access to the account by the User.
3.3. User is responsible for maintaining the confidentiality of login, password information. VIPGAMESZONE is not liable for any account disputes that may arise between various parties holding account login information. VIPGAMESZONE is not responsible for any changes made to the account or any information that has been modified by User, or any parties authorized by User, to access the Control Panel.
3.4. User is responsible for updating and maintaining contact information with VIPGAMESZONE. User is responsible for ensuring that VIPGAMESZONE is able to notify the User for technical, or other issues or purposes deemed necessary by VIPGAMESZONE to maintain the account.
3.5. VIPGAMESZONE reserves the right to refuse service to anyone in violation of our Terms of Service or the Acceptable Use Policy (AUP) set forth below or anyone using our networks or servers for unlawful purposes.
3.6. User agrees to abide by all terms outlined in our AUP. Any violation of those terms will result in the actions outlined in our AUP.
3.7. VIPGAMESZONE does not proactively review the user’s account content or messages of our Users. In some situations, as outlined herein or in our AUP, we will review and remove files, user’s account content or e-mail to validate compliance with our AUP.
4. CANCELLATION POLICY
4.1. You are free to cancel your account at any time. Similarly, we reserve the right to cancel any account at any time, for any reason, including, but not limited to, a breach of this Agreement or the AUP.
4.2. If you do not wish to continue use our services, it is your responsibility to contact our Support Team to cancel your account
5. BACKUP/RESTORE
5.1. VIPGAMESZONE does not maintain backup copies of User account or messages.
5.2. VIPGAMESZONE cannot guarantee that the contents of an account will never be deleted or corrupted, or that a backup of an account will always be available.
5.3. We ALWAYS recommend that User copy all content of an account to a local computer and strongly suggest that Users make an additional copy (on tape, CD, multiple floppies, another desktop, or elsewhere) to ensure the availability of the files.
7. LIMITATION OF LIABILITY
7.1. Limitation of Liability. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL VIPGAMESZONE OR ITS SUPPLIERS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF OR RELATING TO THIS LICENSE, EVEN IF VIPGAMESZONE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THIS LIMITATION MAY NOT APPLY TO YOU. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.
